2009 Traffic Results

2009: Municipal Court – Client was charged with 39:4-97 Careless driving, a two point ticket. Client’s vehicle struck the back of another vehicle in heavy traffic while trying to change lanes.

Result: The charge of 39:4-97 Careless Driving was amended to 38:4-67 Obstructing passage of other vehicles, and a $91 fine was assessed.


2009: Municipal Court – Client was charged with 39:3-40 Driving while Revoked.

Result: The charge, 39:3-40, was amended to 39:3-10a License Restoration Fee, and fines were assessed at $30
with $33 in court fees.


2009: Municipal Court – Client was pulled over after being found to be going 45 in a 25. The client was charged
with 39:4-98 Speeding, which would be a four point ticket.

Result: The charge of 39:4-98, 45 in a 25,was amended to 39:4-97.2(g) Driving in an Unsafe Manner, which has
no points. The client was also fined $406 plus $33 in court fees.


2009: Municipal Court – Client was pulled over for 39:4-98 speeding, 94 in 55, which is a five point ticket. The client was also given a ticket for 39:4-97 Careless Driving, a two point offense.

Result: 39:4-98, 94 in a 55, was amended to 69 in a 55, which is two points. 39:4-97 was amended to 39:4-67 Obstructing passage of other vehicles. A fine of $61 was assessed along with $33 in court fees.


2009: Municipal Court – Client was pulled over for doing 90 in a 65, and given a ticket for 39:4-98 speeding a 4
point ticket.

Result: The charge of 39:4-98 was amended to 39:4-97.2(g) Driving in an Unsafe Manner. A fine in the amount of $406 plus $33 in court fees was assessed. NO POINTS.


2009: Municipal Court – Client was pulled over doing 92 in a 65, and ticketed for 39:4-98 speeding, a five point
ticket. The client was also charged with 39:3-40 Driving while Suspended under 39:3-40 and was facing a 6 month suspension of license.

Result: 39:4-98 was amended down to 69 in a 65, a two point ticket, while 39:3-40 was amended down to 39:3-10 Unlicensed Driver. NO LICENSE SUSPENSION


2009: Municipal Court – Client was pulled over for driving 96 in a 65, a five point ticket, 39:4-98 Speeding. The client was also given a ticket for 39:4-97 Careless Driving, a two point ticket.

Result: The speed for 39:4-98 was amended down to 79 in a 65, a two point ticket and 39:4-97 Careless Driving was dismissed. The client was assessed $407 in fines and $33 in court fees.


2009: Municipal Court – Client was pulled over and ticketed for 39:4-52 Racing a five point ticket, 39:4-96 Reckless Driving a five point ticket, and 39:4-124 Improper Turn a three point ticket for a total of 13 points.

Result: 39:4-52 was amended to 39:4-97 Careless Driving a two point offense. 39:4-96 was amended to a second count of 39:4-97, and 39:4-124 was dismissed.


2009: Municipal Court – Client was driving and rear-ended the vehicle that was in front of him, which caused that vehicle to strike the one that it was in front of. Client was charged with 39:3-97 Careless Driving a two point ticket, and 39:4-89 Following to closely a 5 point ticket.

Result: Client pled guilty to 39:3-97 Careless Driving and was required to pay civil restitution to the other drivers. The Following too Closely was dismissed.


2009: Municipal Court – Client was pulled over and ticketed for Driving while Suspended 39:3-40 with Illinois license facing 6 month suspension.

Result: Attorney delayed case until client could go to Chicago and straighten out license. The charge was then amended to 39:3-10(a) Unlicensed Driver with a fine of $306 plus $33 in court fees.


2009: Municipal Court – Client was charged with 39:6b-2 No Insurance facing 1 year license suspension.

Result: The charge was amended to 39:3-29 Failure to Exhibit Documents with $156 in fines plus court fees.


2009: Municipal Court – Client was pulled over while doing 95 in a 65 zone, and ticket for 39:4-98 Speeding a 5 point ticket.

Result: Attorney obtained an amended charge of doing 79 in a 65, Speeding 39:4-98, a 2 point violation with $289 in fines.


2009: Municipal Court – Client was charged with 39:6B-2 No Insurance, 30:3-4 No Registration, 39:3-33 Improper License Plate Display, and 39:4-123 Improper Turn.

Result: 39:3-33 Improper License Plate Display was dismissed. The 39:6B-2 No Insurance was amended to 39:3- 29 Failure to Produce as was 39:3-4. Improper turn 39:4-123 was amended to 39:4-97.2 Driving in an Unsafe
Manner. NO POINTS. NO LICENSE SUSPENSION.


2009: Municipal Court – Client was involved in an automobile accident. The client was charged with 39:4-97 Careless Driving, 39:4-129 Leaving the Scene of an Accident (facing a 6 month license suspension), and 39:4-130 Failure to Report Accident.

Result: Both 39:4-129 Leaving the Scene and 39:4-130 Failure to Report were dismissed and the client pled guilty to an amended charge of 39:4-97.2 Driving in an Unsafe Manner. NO POINTS. NO LICENSE SUSPENSION.


2009: Municipal Court – Client was pulled over for speeding under 39:4-98 Speeding for doing 100 in a 65 (a 5 point ticket and possible license suspension) and 39:4-96 Reckless Driving (a 5 point ticket) for a total of 10 points.

Result: The charge 39:4-98 Speeding was amended down to 85 in a 65, 4 points, and the 39:4-96 Reckless Driving was dismissed.
