The Sussex County Prosecutor’s office objected to this expungement on the grounds that the conviction was for the sale or distribution of a controlled dangerous substance of possession with intent to sell or distribute. In New Jersey possession with intent is considered to be a special expungement. The Petitioner appeared in the Union Township Municipal Court where the petitioner pled guilty to an amended charge in violation of borough ordinance 250-1, Disorderly Conduct-Rough Behavior, and was fined.

The Petitioner was arrested on July 9, 2016, for charge in violation of two counts of N.J.S.A. 2C:35-10A(1), Possession CDS- Fail to Give to Police. The Petitioner appeared in the Woodbridge Township Municipal Court after it was remanded from the Middlesex County Prosecutor’s office and all charges were dismissed.

The Petitioner was arrested on August 18, 2004, for charge in violation of N.J.S.A. 2C: 12-1B(1) and 2C:2-6, Aggravated Assault, and in violation of N.J.S.A.2C:39-4D, Possession of Weapon for an Unlawful Purpose. The Petitioner appeared in the Passaic County Superior Court on October 13, 2006, under Indictment No: 04-12-1728-I, where the Petitioner was found guilty of N.J.S.A. 2C:12-1B(2), Agg assault w/deadly weapon-bodily injury-lesser included offense, in violation of N.J.S.A.2C:12-1B(3), Serious bodily injury-agg assault- lesser included offense, and in violation ofN.J.S.A.2C:39-4(D), Possession of Weapon for an Unlawful Purpose, and was sentenced to 3 years’ probation and was fined.

The Passaic County Prosecutor’s office entered an objection because the petitioner did not meet the 10-year waiting period for Indictable offenses. The petitioner did not finish probation until 2009, so therefore is not eligible until 2019. The firm submitted a legal brief and character reference letters as is required and the judge granted the early expungement. The office was able to show that petitioner has remained employed and went back to school to get a degree. We were able to demonstrate how the conviction was affecting their ability to provide for the family financially. With the conviction the Petitioner could not help coaching their children’s sports teams or help family friends in need of a new home by becoming a foster parent.

2018: Bergen County. All records Expunged. Early Expungement.

The Petitioner was arrested on June 8, 2011, for charge in violation of N.J.S.A. 2C:39-5B, Unlawful Possession Weapon-Handguns without Permit.

The Petitioner appeared in the Bergen County Superior Court where the petitioner pled guilty and was fined. The Petitioner was placed on Probation for a term of 1 year or until he paid his fines whichever came first. The Petitioner paid his fines in full on February 7, 2013. The Bergen County Prosecutor’s office entered an objection because the petitioner did not meet the 10-year waiting period for Indictable offenses. The petitioner did not finish paying off his fine until 2013, so therefore is not eligible until 2023. The firm submitted a legal brief and character reference letters as is required and the judge granted the early expungement. The office was able to show that petitioner has changes their life around. The Petitioner now has multiple children and has purchased a house. The conviction was affecting their job, they could not get clearance to go on a military base to do the contracted work or move up in the company.

The Petitioner appeared in the Middlesex County Superior Court where the Petitioner pled guilty to charges in violation of N.J.S.A. 2C:5-2, Conspiracy, and in violation of one count of N.J.S.A. 2C:35-5B(2), MFG/D/D Her/Coke >=.5oz<5oz, and was fined. The Petitioners Parole was terminated on December 9, 2012.

The Petitioner was arrested on September 9, 2010, for charge in violation of N.J.S.A. 2C:12-1B(1), Aggravated Assault. The Petitioner appeared in the Passaic County Superior Court where the Petitioner pled guilty to an amended charge in violation of N.J.S.A. 2C:12-1A, Simple Assault and was fined.

The Passaic County Prosecutor’s office objected to this expungement on the grounds that the conviction was for the sale or distribution of a controlled dangerous substance of possession with intent to sell or distribute. In New Jersey possession with intent is considered to be a special expungement. The firm submitted a legal brief and character reference letters as is required and the Judge granted the special expungement. The firm was able to show how the petitioner has changed since his conviction. started to work full time in sales while still participating in various community service projects. The law firm also explained how the petitioner created his own company and they cannot expand upon that business because of the criminal record. This was putting a financial strain of the Petitioner’s family. The Petitioner was also looking to get a real estate’s license but could not obtain one with a criminal record.

2018: Ocean County. All records Expunged. Special Interest and Early Expungement.

The Petitioner was arrested on March 21, 2008, for charge in violation of N.J.S.A. 2C:36-2, Use/Possess W/Intent to Use Drug Paraphernalia. The Petitioner appeared in the Jackson Township Municipal Court where Petitioner was found guilty and given a one-year term of probation and fined.

The Petitioner was arrested on September 1, 2008, for charge in violation of N.J.S.A. 2C:35-10A(4), Possession CDS. The Petitioner appeared in the Howell Township Municipal Court where the charges were dismissed.

The Petitioner was arrested on February 10, 2009, for charge in violation of N.J.S.A. 2C:35-10A(4), Possession CDS under 50 grams, and in violation of N.J.S.A. 2C:26-2, Use/Poss W/Intent. The Petitioner appeared in the Wall Township Municipal Court and was found guilty of an amended violation of N.J.S.A. 2C:33-2.1B, Wandering/Prowling to Obtain/Sell with the charges with all other charges being dismissed.

The Petitioner was arrested on July 8, 2010, for charge in violation of N.J.S.A.. 2C:35-10A(4), Possession, Possession With Intent, and in violation of N.J.S.A. 2C:36-2, Use Paraphernalia. The Petitioner appeared in the Superior Court of Ocean County where Petitioner was found guilty of N.J.S.A. 2C:35-5A(1), Manufacture, Distribution, Dispense, and in violation of N.J.S.A. 2C:35-5B(13), MFG/D/D Other, and sentenced to a two year term of probation and fined.

The Ocean County Prosecutor’s office objected to this expungement on the grounds that the conviction was for the sale or distribution of a controlled dangerous substance of possession with intent to sell or distribute. In New Jersey possession with intent is considered to be a special expungement. Also, because the petitioner did not meet the 10-year waiting period for Indictable offenses. The petitioner did not finish probation until 2013, so therefore is not eligible until 2023. The firm was able to show how the petitioner has changed since his conviction. The Petitioner started to work full time in a company that is willing to invest in them. The Petitioner went back to school for a degree so they could eventually become a Surveying Engineer. The law firm also explained how the petitioner has worked so hard in school holding a high GPA but will need to get a State License to use their degree but will be denied because of a criminal record.

2018: Atlantic County. All records Expunged.

The Petitioner was arrested on April 26, 2010, for charge in violation of N.J.S.A. 2C:5-1A, Criminal Attempt. The Petitioner appeared in the Atlantic City Municipal Court where the Petitioner was found guilty of an amended charge in violation of N.J.S.A. 2C:20-4A, Theft by Deception-False Impression, and fined.

2018: Sussex County. All records Expunged. Drug Court Expungement.
The Petitioner was arrested on August 28, 2008, for charge in violation of N.J.S.A. 2C:35-10a(1), Possession CDS, and in violation of N.J.S.A. 2C:35-10a(1), Possession of CDS. The Petitioner appeared in the East Orange Municipal Court where the charges were downgraded to two counts in violation of N.J.S.A. 2C:36-2, Possession of Drug Paraphernalia and all other charges were dismissed.

The Petitioner was arrested on January 31, 2009 and February 10, 2009, for charge in violation of N.J.S.A. 2C:18-2a(1), third degree Burglary, and in violation of N.J.S.A. 2C: 20-3a, third degree Theft, in violation of N.J.S.A. 2C:20-3;with third degree Burglary, in violation of N.J.S.A. 2C:18-2a(1); with third degree Burglary, in violation of N.J.S.A. 2C:18-2a(1); with disorderly persons Theft, in violation of N.J.S.A. 2C:20-3a; with disorderly persons Theft, in violation of N.J.S.A. 2C:20-3a and charged under with third degree Burglary in violation of N.J.S.A. 2C:18-2a(1). The Petitioner appeared in the Sussex County Superior Court where the Petitioner was found guilty of charges in violation of in violation of N.J.S.A.2C:18-2a(1) and was sentenced to Drug Court. The Petitioner was arrested on March 11, 2009, for charge in violation of N.J.S.A. 36-2, disorderly persons Possession of Drug Paraphernalia, and in violation of N.J.S.A. 2C:33-2.1B, disorderly persons Prowling and in violation of N.J.S.A. 2C:36-2, disorderly persons Possession of Drug Paraphernalia. The Petitioner appeared in the East Orange Municipal Court and pled guilty and was fined. On October 22, 2012, the Petitioner successfully graduated from the Sussex County Drug Court program accordingly pursuant to N.J.S.A. 2C:35-14(M), the petitioner seeks the expungement of their entire record.

The Petitioner was arrested on May 22, 2011, for charge in violation of N.J.S.A. 2C:39-5B, Unlawful Poss Weapon-Handgun , in violation of N.J.S.A. 2C:39-4.1A, Possession of a firearm while committing drug crimes, in violation of N.J.S.A. 2C:35-5B(5), CDS-Manufacture or Distribution, and in violation of N.J.S.A. 2C:35-10A(1), Possession of CDS, and in violation of N.J.S.A. 2C:35-10A(4), Possession of CDS < 50G. The Petitioner appeared in the Monmouth County Superior Court where the Petitioner pled guilty to the charge in violation of N.J.S.A. 2C:39-5B, Unlawful Possession of Weapons-Air/Spring, and was sentenced to 1year probation with all other charges being dismissed.

The Petitioner was arrested on October 7, 2017, for charge in violation of N.J.S.A. 2C:12-1A(1), Simple Assault. The Petitioner appeared in the Hanover Municipal Court where the petitioner pled guilty to an amended charge in violation of Borough Ordinance 202, Loitering, and was fined.

The Petitioner was arrested on May 23, 2008, for charge in violation of N.J.S.A.2C:36-6, Poss/Dist Hypodermic syringe/needle. The Petitioner appeared in the Vernon Township Municipal Court where the Petitioner pled guilty and was sentenced to one-year probation and fined.

The Petitioner was arrested on February 7, 2008, for charge in violation of N.J.S.A.2C:35-10A, Poss of CDS, in violation of N.J.S.A.2C:35-10B,CDS- Under Influence w/o Prescription, in violation of N.J.S.A.2C:36-2, Use/Poss w/intent to use drug paraphernalia, and in violation of N.J.S.A.2C:36-6, Poss/Dist Hypodermic syringe/needle. The Petitioner appeared in the Sussex County Superior Court and pled guilty to charge in violation of N.J.S.A. 2C:35-10A.

The Petitioner was arrested on February 2, 2008, for charge in violation of N.J.S.A.2C:35-5B(1), CDS-Manu/Dist/Pwid, in violation of N.J.S.A.2C:35-7,CDS/Analog-Distribute on/near school property/bus, in violation of N.J.S.A.2C:35-10A(1),Poss CDS/Analog, in violation of N.J.S.A.2C:36-2, Use/Poss with intent to use drug paraphernalia, and in violation of N.J.S.A. 2C:36-6, Poss/Dist Hypodermic Syringe/Needle. The Petitioner appeared in the Passaic County Superior Court and pled guilty to charge in violation of N.J.S.A. 2C:35-10A(1) and was sentenced to four years’ probation.

The Petitioner was arrested on March 14, 2008, for charge in violation of N.J.S.A 2C:35-10A(1), Poss of CDS, in violation of N.J.S.A. 2C:36-2, Use/Poss W/intent to use drug paraphernalia, and in violation of N.J.S.A.2C:36-6, Poss/Dist Hypodermic Syringe/ Needle. The Petitioner appeared in the Monmouth County Superior and pled guilty to a downgraded charge in violation of N.J.S.A.2C:5-2, Conspiracy, and was accepted into Drug Court.

The Petitioner was arrested on April 10, 2008, for charge in violation of N.J.S.A 2:36-2, Use/Poss w/intent to use drug paraphernalia and in violation of N.J.S.A.2C:35-10B, CDS-under influence w/o prescription. The Petitioner appeared in the Franklin Lakes Borough Municipal Court where the charges were dismissed.

The Petitioner has successfully graduated from the Monmouth County Drug Court Program on January 30, 2012. Accordingly, pursuant to N.J.S.A. 2C:35-14(m), the Petitioner seeks the expungement of their entire criminal record.
