2013 DMV License Restoration: Client went to the Motor Vehicle Commission to transfer driver’s license and car registration and title from Pennsylvania to New Jersey. When Client’s name was run through the National Drivers Register an issue arose with respect to a driver’s license in Florida. The Client had never lived or driven in Florida and was told by the MVC that he needed a clearance letter from the State of Florida in order to get a New Jersey license. The State of Florida had no record of him in their system, the reference number provided by New Jersey belonged to another individual with a different last name.
Result: Attorney resolved the matter with DMV and Client was granted his driving privileges in the State of New Jersey.
2013 Municipal Court – Client came to attorney because he was facing a suspension for having too many points. He had pled guilty to to 39:4-97 Careless Driving (2 points) in one town and 39:4-97 Careless Driving and 39:4-89 Tailgating (5 points) in a second town.
Result: Attorney filed motions to re-open both matters. In the first town the 39:4-97 Careless Driving was amended to 39:4-97.2 Driving in an Unsafe Manner, a no point ticket. In the second town client pled guilty to the 39:4-97 and the 39:4-89 was dismissed. Client had to pay court fees and fines in the amount of $239.
2013 – Municipal Court: Client was proceeding to a traffic signal, and was unable to come to a complete stop striking the vehicle in front of it. The client was charged with 39:4-96 Careless Driving, a 2 point ticket.
Result: Attorney obtained an amendment of the 2 point 39:4-96 Careless Driving to a no point 39:4-56 Delaying Traffic with $236 in court fines and fees.
2013 – Municipal Court and Motor Vehicle Commission: Client had a number of motor vehicle tickets totaling 52 points on his driver’s license. When client pled guilty to 39:4-98 Speeding, he was assessed an additional 2 points on his license. At that time he received notice from the Motor Vehicle Commission that his driving privileges were being suspended for 360 days.
Result: The attorney requested a hearing on the scheduled suspension from DMV and filed a motion to withdraw the guilty plea to the speeding charge in the Municipal Court. The guilty plea to 39:4-98 Speeding was vacated and the charge was amended to 39:4-87.1 Failing to Yield in a Bus Lane, a no point ticket. As a result the DMV Hearing resulted in no suspension to the client.
2013 – Municipal Court: Client had a number of tickets stemming from his driving privileges being suspended in New Jersey. On two separate occasions he was ticketed, the first for 39:3-40 Driving While Suspended, 39:3-40 Registration Suspended, and 39:3-29 Failure to Produce Proof of Insurance. The second instance he was ticked against for 39:3-40 Driving While Suspended, 39:3-40 Registration Suspended, and 39:6B-2 Uninsured Motorist. The client was facing over two years of license suspensions and mandatory jail.
Result: The court amended one count of 39:3-40 to 39:3-40(i) Administrative Suspension with no Suspension, and client pled guilty. Client also pled guilty to 39:3-29 Failure to Produce Proof of Insurance. All other charges were dismissed, and client paid approximately $200 in court fines and fees.
2013 – Municipal Court: Client was pulled over and charged with 39:3-40 Driving While Suspended, , 39;3-40 Registration Suspended, 39:6B-2 Uninsured Motorist, 39:3-4 Unregistered Vehicle, 39:3-29 Failure to Produce Proof of Insurance, 39:3-75 Cracked Windshield, 39:3-10B Unlicensed Driver, and 39:8-1 Failed Inspection. Client was facing a two year suspension and mandatory jail time because it was a 3rd offense Driving While Suspended.
Result: Client pled guilty to 39:6B Uninsured Motorist and received a $500 fine and 1 year suspension of driving privileges. All other charges were dismissed and the client did not go to jail.
2013 – Municipal Court: The officer was conducting random registration checks on vehicles and pulled over the client for having an unregistered vehicle. The client was also unable to produce proof of insurance. Client was ticketed for 39:3-4 Unregistered Vehicle and 39:3-29 Failure to Produce Proof of Insurance, and 39:6B-2 Uninsured Vehicle.
Result: A plea agreement was reached where client pled guilty to 39:3-4 Unregistered Vehicle and the 39:6B-2 and 39:3-29 were dismissed. Client paid $118 in fines and court fees.
2013 – Municipal Court: Client pulled into a parking lot and struck a disabled vehicle. The police were called and the client was issued a summons for 39:4-97 Careless Driving. When the client’s license was run it came up as suspended for failure to appear on a traffic summons, so he was issued another ticket for 39:3-40 Driving While Suspended.
Result: The Attorney obtained a letter from the Motor Vehicle Commission stating that the license was not supposed to be suspended for failure to appear because those summons had been satisfied. The Court dismissed 39:3-40 Driving While Suspended for this reason. The Client pled guilty to an amended charge of 39:4-97.2 Driving in an Unsafe Manner and was assessed $480 in fines and court fees.
2013 – Municipal Court: Client was ticketed for 39:4-97 Careless Driving, a two point ticket.
Result: The 39:4-97 was amended down to 39:4-56 Delaying Traffic, a no point ticket, and Client pled guilty to the amended charge. Client had to pay $190 in fines and court fees.
2013 – Motor Vehicle Commission: Client was facing a two year suspension of New Jersey driving privileges for misrepresenting information to the Motor Vehicle Commission. He had received a driver’s license in New York under one Social Security number and then surrendered that license back to New York. He then came to New Jersey and obtained a driver’s license with a different Social Security number..
Result: At a pre-hearing conference the attorney obtained a reduction of the two year suspension down to six months.
2013 – Municipal Court: Client was pulling out of a friend’s driveway and lightly struck a vehicle parked on the street. Not realizing that she struck a vehicle, Client left the scene of the accident. Later, she was issued summons for 39:4-129B Leaving the Scene of an Accident (2 points and a mandatory 6 month license suspension), 39:4-130 Failure to Report an Accident, and 39:4-97 Careless Driving (2 points).
Result: Attorney obtained a dismissal of the Leaving the Scene 39:4-129B so the client did not lose her license Client plead guilty to 39:4-130 Failure to Report and the 9:4-97 was amended to 39:4-97.2 Unsafe Driving, a no point ticket. The end result was that client did not receive any points on her license and paid $528 in fines and court fees. Client also had to pay civil restitution for the damage for the other vehicle.
2013 – Motor Vehicle Commission: Client was two months into a driver probationary period when he was ticketed for Careless Driving. The Client received notice that his driving privileges were going to be suspended for 90 days.
Result: Attorney argued an undue hardship and extenuating personal circumstances and the suspension was reduced to 30 days.
2013 – Municipal Court: Client was parked in a handicapped parking spot using another individual’s handicapped permit. When ticketed she was unable to provide proof of car insurance. She was charged with 39:6B-2 Uninsured Motorist, 39:4-197 Parked in a Handicapped Spot, and 39:4-205 Using Another’s Handicapped ID.
Result: 39:6B-2 Uninsured Motorist was amended to 39:3-29 Failure to Produce Insurance Documents, and Client pled guilty. Client also pled guilty to 39:4-197 Parking in Handicapped Spot. The Court dismissed 39:4-205. Client paid $280 in fines and court fees.
