Randolph H. Wolf Teaches Expungement Seminar on Behalf of the Monmouth County Bar Association

On December 4, 2015, Randolph H. Wolf was selected to teach an expungement seminar on behalf of the Monmouth County Bar Association. The seminar was taught to approximately 30-40 other New Jersey lawyers who were interested in learning more about expungements in New Jersey in return for continuing legal education (“CLE”) credit. During the lecture, Mr. Wolf talked about the expungement process in New Jersey, eligibility requirements, and recent expungement case law and developments.

With respect to recent expungement law developments, Mr. Wolf discussed three of the most recent New Jersey Supreme Court decisions regarding expungements. The first two cases Mr. Wolf discussed included In the Matter of the Expungement Petition of J.S. and In the Matter of the Expungement of the Criminal Records of G.P.B. In those cases, the Court addressed the “crime spree” exception to expungements in New Jersey. There the Court made clear that the expungement statute in New Jersey, N.J.S.A. 2C:52-2, only allows the expungement of a single conviction arising from multiple offenses only if the offenses occurred as part of a single, uninterrupted criminal event. Thus, the decision severely limited the “crime spree” exception that existed under prior case law. Mr. Wolf also discussed In the Matter of Expungement Application of D.J.B., a case that Mr. Wolf himself argued before the New Jersey Supreme Court. There the Court was considering whether or not juvenile adjudications could be used to bar subsequent adult convictions. Mr. Wolf talked about the procedural history leading up to that case along with the arguments he made both in his brief and during oral argument before the New Jersey Supreme Court. The Supreme Court in D.J.B. ultimately agreed with Mr. Wolf’s arguments and held that juvenile adjudications could not bar the expungement of adult convictions.
