DWI/DUI Defense for Out-of-State Drivers

If a driver with a license issued from another state (out-of-state driver) is issued a summons for a DWI (driving while intoxicated), DUI (driving under the influence of alcohol), or refusal to submit to a breath test in New Jersey, he or she is subject to the same fines, penalties, and jail time as a New Jersey Driver.

However, New Jersey’s courts only have jurisdiction over your driving privileges in the state of New Jersey and cannot suspend or revoke your driver’s license if your license was issued in another state. It is the decision of your home state’s Department of Motor Vehicles what type of further action it will take.
