2019 Expungement Results

2019: Ocean County. All records Expunged.

The Petitioner was arrested on February 15, 1966, for charges in violation of Vehicle Theft. The Petitioner appeared in the North Brunswick Township Municipal Court where the Petitioner pled guilty and was fined.

The Petitioner was arrested on March 14, 1966, for charges in violation of N.J. 2A:119-2, Larceny. Results unknown as both the Municipal Court and Superior Court could not find any records.

The Petitioner was arrested on April 10, 1976, for charges in violation of   N.J.S.A. 2A:170-30.1, Larceny. The Petitioner appeared in the Ocean Township Municipal Court where the petitioner pled guilty and was fined.

The Petitioner was arrested on August 2, 1986, for charges in violation of N.J.S.A. 2C:20-11, Shoplifting. The Petitioner appeared in the East Brunswick Township Municipal Court where the Petitioner pled guilty and was fined.

The Petitioner was arrested on August 23, 2013, for charges in violation of N.J.S.A. 2C:20-11B(1),Shoplifting-Take Merchandise without paying. The Petitioner appeared in the Eatontown Municipal Court where the Petitioner guilty to an amended charge in violation of Borough Ordinance 218, Noise, and was fined.

The Petitioner was arrested on August 1, 1990, for charges in violation of  N.J.S.A.2C:35-7, Distribution of CDS on or within 1,000 feet of school property, in violation of 2C:33-2A2, Disorderly conduct- Creates a hazardous or physically dangerous condition, in violation of  N.J.S.A.2C:35-10A4, Possession of 50 grams or less of marijuana, and a violation of N.J.S.A.2C:36-2, Use or possession with intent to use. The Petitioner appeared in the Bergen County Superior Court and was accepted into the Pre-Trial Intervention Program and with successful completion, an Order of Dismissal was entered.

The Petitioner was arrested on December 17, 1998, for charges in violation of N.J.S.A.  2C:35-10A(3), Possession of CDS, and in violation of  N.J.S.A. 2C:35-5A(1),Manufacture/ Distribute CDS or Intent to Manufacture/ Distribute CDS. The Petitioner appeared in the Monmouth County Superior Court  where the petitioner pled guilty to charges in violation of N.J.S.A 2C:5-2 & 2C:35-10A(3) and was sentenced to two years of probation.

The Petitioner was arrested on January 20, 2015, for charges in violation of N.J.S.A. 2C:12-1A, Simple Assault. The Petitioner appeared in the Midland Park Borough Municipal Court where all charges were dismissed.

The Petitioner was arrested on February 28, 2009, for charges in violation of N.J.S.A. 2C:39-3E, Prohibited Weapons and Devices, an in violation of N.J.S.A 2C:35-24, Possession of Prescription Drugs in Original Container. The Petitioner appeared in the Hazlet/Matawan Joint Municipal Court where the petitioner was granted a conditional discharge and the charges were dismissed.

The Petitioner was arrested on August 18, 2010, for charges in violation of N.J.S.A.2C:20-11C(4), Shoplifting. The Petitioner appeared in the Hazlet/Matawan Joint Municipal Court where the charges were dismissed.

The Petitioner was arrested on August 5, 2011, for charges in violation of N.J.S.A.2C:35-10a(1), Possession of CDS, and two counts of N.J.S.A.2C:35-5b(5), CDS-MFG/D/D/Other I, II,III, IV, N.J.S.A.2C:35-7, CDS/Analog-Distribute on/near school property/bus, N.J.S.A.2C:35-10a(1), Possession of CDS, N.J.S.A. 2C:35-5B(13), CDS-MFG/D/D/Other I, II,III, IV. The Petitioner appeared in the Superior Court of Monmouth County where the Petitioner was found guilty and was sentenced to Drug court.

Pursuant to N.J. S.A. 2C:35-14(m), the Petitioner had their entire criminal record expunged as  they had successfully graduated from drug court.

2019: Atlantic County. All records Expunged.

The Petitioner was arrested on April 26, 2010, for charges in violation of N.J.S.A. 2C:5-1A, Criminal Attempt. The Petitioner appeared in the Atlantic City Municipal Court where the Petitioner pled guilty to an amended charge in violation of N.J.S.A. 2C:20-4A, Theft by Deception-False Impression, and was fined.

2019: Union County. All records Expunged. Public Interest Expungement.

The Petitioner was arrested on August 31, 1972, for charges in violation of N.J.S. 24:21-20(A), Possession CDS, N.J.S. 24:21-19A(1), Possession CDS w/intent/distribute, and  N.J.S. 2A:151-41(C), Possession of a Weapon. The Petitioner appeared in the Union County Superior Court where the petitioner was convicted of N.J.S.24:21-19(A)(1), Possession of a Controlled Dangerous Substance w/intent/distribute. The Judgement indicates there was more than 25 grams of marijuana but does not specify if it was over or under one ounce. 

The Union County Prosecutor’s office objected to this expungement on the grounds that the conviction was for the sale or distribution of a controlled dangerous substance of possession with intent to sell or distribute. In New Jersey possession with intent is considered to be a special expungement requiring a finding of the Expungement being in the Public Interest.   The firm submitted a legal brief and character reference letters as is required and the Judge granted the special expungement. The firm was able to show how the petitioner had changed since his conviction over 40 years before, how he worked hard on improving himself by going back to College where and receiving an Associates Degree, and had pursued a career as a carpenter.  The law firm further demonstrated how this conviction affected the Client in that he had started a brand-new business and could not obtain the necessary licensing from the State because of his criminal record. 

2019: Union County. All eligible charges Expunged.

The Petitioner was arrested on May 18, 2002,  for charges in violation of  N.J.S.A. 2C:18-3, Criminal Trespass. The Petitioner appeared in the Union Township Municipal Court where Petitioner pled guilty to an amended charge in violation of  Local Ordinance 209-7, Rough Behavior-Disorderly Conduct,  and was fined.*

The Petitioner was arrested on August 14, 2002, for charges in violation of  N.J.S.A.2C:33-15A, Possession/Consumption of Alcohol Under Legal Age. The Petitioner appeared in the Roselle Park Borough Municipal Court where the charges were dismissed.

The Petitioner was arrested on August 23, 2002, for charges in violation of N.J.S.A. 2C:15-1A(1), Robbery-Inflicts BI or Uses Force, N.J.S.A. 2C:5-5A, Possess, Manufacture Burglar Tools. The Petitioner appeared in the Superior Court of Union County where the Petitioner pled guilty to and amended charge in violation of N.J.S.A.2C:20-3, theft by unlawful taking, and was sentenced to probation.

*This offense was not expunged because, under N.J.S.A. 2C:52-2, a Borough Ordinance cannot be expunged at the same time as a conviction for an Indictable offense. The client is eligible to file a second expungement petition to remove it.

The Petitioner was arrested on July 3, 2007, for charges in violation of Local Ordinance 3-29, Fighting/Misbehaving. The Petitioner appeared in the Point Pleasant Beach where the petitioner pled guilty and was fined.

The Petitioner was arrested on April 20, 2017, for   in violation of N.J.S.A. 2C:35-5B(11), CDS-Manu/Dist/Pwid-Marijuana, in violation of N.J.S.A. 2C:35-10A(3), Possession of CDS, in violation of N.J.S.A. 2C:33-21B, Wandering/Prowling to obtain/sell CDS, and in violation of N.J.S.A.2C:36-2,Use/Poss w/intent to use Drug Paraphernalia. The Petitioner appeared in the Middlesex County Superior Court where the Petitioner was accepted into the Pre-Trial Intervention Program and after successful completion the charges were dismissed.

2019: Monmouth County. All Juvenile records Expunged

The Petitioner was arrested on March 6, 2014, for charges in violation of N.J.S.A. 2C:35-10A(3), Possession of CDS, in  violation of N.J.S.A. 2C:35-7.1,  Poss/Dist/W/IN 500 ft.,  in violation of N.J.S.A. 2C:35-5b(11), CDS-Manu/Dist/Pwid-MA,  and in violation of  N.J.S.A. 2C:36-2, Use/Poss W/Intent To Use. The Petitioner appeared in the Monmouth County Superior Court/Juvenile Division where the Petitioner was found guilty of being in violation of N.J.S.A. 2C:35-10A, Possession of CDS, and all other charges were dismissed.

2019:  Sussex County. All New Jersey Criminal Charges Expunged

The Petitioner was arrested on September 21, 2006, for charges in violation of N.J.S.A. 2C:20-11B(1), Shoplifting. The Petitioner appeared in the Hampton/Stillwater Municipal Court where the petitioner pled guilty and was fined.

The Petitioner was arrested on August 20, 2008, for charges in violation of N.J.S.A.  2C:20-11b(1), Shoplifting. The Petitioner appeared in the Superior Court of Sussex County where the petitioner pled guilty and was fined.

The Petitioner was arrested on February 5, 2009, for charges in violation of N.J.S.A.  2C:20-11B(2), Shoplifting. The Petitioner appeared in the North Warren Municipal where the petitioner pled guilty to an amended charge in violation of N.J.S.A. 2C:20-3, Theft by Unlawful Taking, and was fined.

The Petitioner was arrested on April 30, 2017, for charges in violation of Fish and Game laws 23:3-1B(2), Failure to exhibit license upon request. The Petitioner appeared in the Frankford Joint Municipal Court where the petitioner pled guilty and was fined. As this was not an offense under the New Jersey criminal code it was not eligible for expungement.   

The Petitioner was arrested in the State of Pennsylvania and charged with violation of 1 18 & 3929 && 1, Retail Theft-Take Merchandise.  The Petitioner appeared in the Magisterial District Court 43-3-02 where petitioner was found guilty of the charge of Retail Theft.*

* As this was not a New Jersey matter this is still on Petitioner’s criminal record.

2019:  Mercer County. All records Expunged.

The Petitioner was arrested on April 25, 1998, for charges in violation of N.J.S.A. 2C:39-5B, Unlawful Possession of a weapon-handgun and dum dum bullets. The Petitioner appeared in the Mercer County Superior Court and was accepted into the Pre-Trial Intervention program. After successful completion the charges were dismissed

The Petitioner was arrested on July 21, 1989, for charges in violation of N.J.S.A. 2C:21-6, Poss and Use of Stole Credit Card. The Petitioner appeared in the Eatontown Municipal Court where the petitioner pled guilty to an amended charge in violation of N.J.S.A.2C:21-17, Impersonation; Theft of Identity; crime, and was fined.

The Petitioner was arrested on May 30, 2007, for charges in violation of N.J.S.A. 2C:24-4A, Endangering- Abuse/Neglect to Child. The Petitioner appeared in the Camden County Superior Court where the original charge of N.J.S.A. 2C:24-4A was downgraded to a violation of N.J.S.A 9:6-1/9:6-3, Abuse and Neglect, and the Petitioner pled guilty and was placed on 1-year Probation.

The Petitioner was arrested on January 29, 1996, for charges in violation of N.J.S.A.2C:17-3A(1), Criminal Mischief-Damage Property, N.J.S.A.2C:17 3A(1), Criminal Mischief-Damage Property, N.J.S.A. 2C:17-3, Criminal Mischief. 

The Petitioner was arrested on February 7, 1996, for charges in violation of N.J.S.A.2C:17-3, Criminal Mischief. 

The Petitioner appeared in the Hunterdon County Superior Court where the Petitioner was accepted into the Pre-Trial Intervention program and after successful completion, the charges were dismissed. 

The Petitioner was arrested on July 18, 1998, for charges in violation of N.J.S.A. 2A:170-77.8, Unlawful Possession of Prescription Legend Drug and in violation of N.J.S.A. 2C:39-5C(1), Unlawful Possession of Weapon-rifles/shotgun. The Petitioner appeared in the Warren County Superior Court where the Petitioner pled guilty to charge in violation of N.J.S.A.2C:39-5C(1) and was sentenced to three years’ probation. 

The Petitioner was arrested in the State of Virginia and was charged with being in violation of Virginia State Law 18.2-308.2:2, False Statements to obtain firearm and, 18.2-26, Attempt to Possess Firearm. The Petitioner appeared in the Norfolk General District Court and was found guilty. *

2019: Salem County. All records Expunged. Special Public Interest Expungement.

The Petitioner was arrested on October 13, 2009, for charges in violation of N.J.S.A. 2C:35-10.5E(1), Prescription/Legend Drugs-Possession Without a Script, and in violation of N.J.S.A. 2C:35-24, Possession of Certain Prescription Drugs, in violation of N.J.S.A. 2C:35-10.5E(1), Prescription/Legend Drugs-Possession Without a Script, in violation of N.J.S.A. 2C:35-24, Possession of Certain Prescription Drugs, in violation  of N.J.S.A. 2C:35-10.5E(1), Prescription/Legend Drugs-Possession Without a Script,  and in violation of  under N.J.S.A. 2C:35-24, Possession of Certain Prescription Drugs The Petitioner was charged with being in violation of N.J.S.A. 2C:35-10A(1), Possession CDS/Analog, in violation of  N.J.S.A. 2C:35-5B(5), MFG/G/G Other  and in violation of N.J.S.A. 2C:35-7, CDS in School Zone, in violation of N.J.S.A. 2C:35-10A(1), Possession CDS/Analog, in violation of  N.J.S.A. 2C:35-5B(5), MFG/G/G Other, in violation of N.J.S.A. 2C:35-7, CDS in School Zone and in violation of N.J.S.A. 2C:35-10.5A(2), Distribution/Possess Prescription Drug. 

The Petitioner appeared in the Salem County Superior Court where the petitioner entered a guilty plea in violation of N.J.S.A. 2C:35-10.5A(2),  Presc/Legend Drugs-Dist/Poss 4 or fewer doses for gain, dismissing all other charges. 

The Salem County Prosecutor’s office objected to this expungement on the grounds that the conviction was for the sale or distribution of a controlled dangerous substance of possession with intent to sell or distribute. In New Jersey possession with intent is considered to be a special expungement that requires a showing that the expungement is in the Public Interest.  The firm submitted a legal brief and character reference letters as is required and the Judge granted the special expungement. The firm was able to show how the petitioner has changed since his conviction and has led an exemplary life with no other arrests.  He has had difficulty obtaining work because of the conviction.  He had also successfully obtained an Associate degree in Fine Arts but could not be financially independent because this criminal record.  Taking all of this into account, the Judge found the expungement to be in the Public Interest.
